USE OF INFORMATION

1. General Provisions

1.1. These Terms of Use of Information (hereinafter, the “Terms”) are established in accordance with the applicable laws of the Republic of Kazakhstan, including, without limitation, the Constitution of the Republic of Kazakhstan, the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan “On Mass Media,” and other regulatory legal acts governing intellectual property and information.

1.2. These Terms govern the conditions of access to and use of any informational materials published on the website https://qalam.global/ (hereinafter, the “Website”), including its subdomains and affiliated digital platforms.

1.3. For the purposes of these Terms, “Information” shall mean any textual, graphic, audiovisual, multimedia, or other materials made available on the Website, unless expressly indicated otherwise with respect to specific materials (e.g., content provided by third parties).

1.4. Unless expressly stated otherwise, all Information constitutes the intellectual property of «Media group «QALAM» Limited Liability Partnership (hereinafter, the “Rights Holder”). All rights in and to the Website and its content are reserved and protected under applicable law.

1.5. Any person accessing the Website and/or using the Information made available thereon (hereinafter, the “User”) shall be deemed to have read, understood, and agreed to be bound by these Terms in their entirety.

2. Conditions for Permitted Use (Quotation)

2.1. Users are permitted to use the Information free of charge by way of quotation, whether in the original language or in translation, for personal, scientific, educational, polemical, critical, or informational purposes, provided that all of the following conditions are simultaneously met:

2.1.1Scope: The extent of the quotation must be justified by the purpose of the quotation and may not exceed 30% (thirty percent) of the original material (article, interview, review, etc.). For short news items, the permissible quotation is limited to one paragraph or 500 (five hundred) characters, including spaces.

2.1.2 Attribution: Each quotation must be accompanied by a clear and explicit indication of the source in the following format:

For text materials: At the beginning of, or immediately following, the quotation, the following wording must be indicated:

“Source: QALAM / qalam.global”.

For graphic, audio, and video materials: A textual reference or caption stating

“Source: QALAM / qalam.global”

must be placed directly adjacent to the material (e.g., below the image or in the description of the video/audio content).

2.1.3 Active Hyperlink: When the Information is used in a digital environment (including websites, blogs, social media platforms, and messaging applications), the source reference must be provided in the form of an active hyperlink directing users either to the homepage of the Website at https://qalam.global/ or to the specific webpage from which the quotation is taken.

2.1.4 No Distortion: The quotation must not distort the original meaning, context, or intent of the Rights Holder’s material. It is prohibited to introduce edits, alterations, or abridgements that modify or misrepresent the substance of the quoted material.

2.2. The use of the Information for commercial purposes (including, but not limited to, advertising, marketing, paid compilations, corporate publications, or fee-based educational courses) fall outside the scope of permitted quotation and requires the prior written consent of the Rights Holder.

3. Prohibited Uses

3.1. Without the prior written consent of the Rights Holder, Users are strictly prohibited from:

Reproducing, copying, publishing, or distributing Website materials in whole or in substantial part beyond the limits permitted under Section 2 of these Terms.

Systematically or regularly copying Website materials in a manner that creates a competing or substitute product.

Modifying, translating, creating derivative works, or otherwise adapting Website materials.

Using trademarks, logos, Website design, or the “QALAM” brand identity without authorization.

Using any automated means, including but not limited to bots, scrapers, or data extraction tools, to access, collect, or harvest Information from the Website.

Using Website materials in any manner that may harm the reputation of the Rights Holder or its partners, or mislead Users regarding authorship, source, or sponsorship.

4. Special Conditions Regarding Translations of Website Materials

4.1. The translation of textual, audio, or video materials published on the Website into any other language constitutes an adaptation and the creation of a derivative work within the meaning of applicable intellectual property laws. Such translation is strictly prohibited without the prior written consent of the Rights Holder.

4.2. Without the prior written authorization of the Rights Holder, it is expressly prohibited to:

4.2.1. Translate Website materials in whole or in substantial part for subsequent publication, distribution, or any other use.

4.2.2. Publish translations of Website materials under one’s own name or without clear and conspicuous identification of the original authorship and source.

4.2.3. Create parallel multilingual versions of resources based on Website materials, including mirrored, adapted, or derivative platforms, without a written agreement with the Rights Holder.

4.3. Exception – Good-Faith Quotation of a Translation

Inclusion of a brief translated excerpt within a User’s own original work (e.g., review, analysis, or academic paper) is permitted solely if all of the following conditions are met:

The length of the translated excerpt does not exceed the quotation limits established in Section 2.1 of these Terms.

The original source (article published on https://qalam.global/ in Russian, Kazakh, or English) is clearly and explicitly identified.

A quotation in the original language or an active hyperlink to the original material is placed adjacent to the translated excerpt.

The text clearly states that the translation has been prepared by the author of the new work and not by the Rights Holder (e.g., “translation by the author”).

4.4. Any other use of translations of Website materials is permitted only pursuant to a separate written license agreement with the Rights Holder. Requests for such authorization must be submitted using the contact information provided in Section 7 of these Terms.

5. Third-Party Content

5.1. The Website may contain materials for which the intellectual property rights belong to third parties (including, but not limited to, stock images, partner materials, guest columns, or contributed content). Such materials are typically identified with an appropriate notice. The User is solely responsible for ensuring the lawful use of any third-party materials obtained from the Website, including use within the scope of quotation. Users must comply with the applicable license terms, rights documentation, and usage rules established by the respective rights holders.

6. Liability and Dispute Resolution

6.1. The Rights Holder makes reasonable efforts to ensure the accuracy, reliability, and timeliness of the Information published on the Website. However, the Rights Holder makes no representations or warranties, express or implied, regarding the completeness, accuracy, or suitability of such Information and shall not be liable for any direct, indirect, incidental, consequential, or other damages arising out of or in connection with its use.

6.2. Any use of the Information in violation of these Terms constitutes an infringement of the exclusive rights of the Rights Holder and a violation of applicable intellectual property laws.

6.3. The Rights Holder reserves the right to assert claims, pursue remedies, and initiate legal proceedings in the courts of the Republic of Kazakhstan to protect its rights and seek compensation for damages incurred.

6.4. Any disputes arising out of or relating to the application, interpretation, or enforcement of these Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan and shall be subject to the jurisdiction of the courts located at the registered place of business of the Rights Holder.

7. Final Provisions

7.1. The Rights Holder reserves the right to amend, revise, or supplement these Terms at its sole discretion at any time, and without prior notice to Users. The most current version of the Terms shall be made available at the following permanent link:

7.2. Continued access to or use of the Website and its Information following the publication of any amendments constitutes the User’s unconditional acceptance of the revised Terms.

7.3. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
